The Widerberg Group at eXp Realty is the trade name of the Site. These Terms of Service govern your access and use of the Site and all publicly available content, services, and/or products provided by The Widerberg Group. Visitors to the Site and users of the Services are referred to as “User” and collectively as “Users.”

You acknowledge that The Widerberg Group is not, and none of the companies affiliated with The Widerberg Group, including but not limited to Illinois Home Auctions Corporation (IHAC), The Widerberg Group at eXp Realty, Ryan Widerberg, eXp World Holdings, or any other named business or business partner, are a registered broker-dealer, investment advisor, investment manager, mortgage loan broker, or funding portal, and none engage in any conduct that would require such registration.

Membership & Account Access

The Services are offered subject to payment of an annual nonrefundable membership fee (the “Membership Fee”) and your acceptance of all terms herein. There is no refund for the Annual Fee, whether in full or pro-rated, in the event of termination. You must create an account, pay the Membership Fee, and provide current, complete, and accurate registration information. Failure to maintain accurate information constitutes a breach that may result in immediate termination of your account.

You are solely responsible for maintaining the security of your passwords and account. You will not transfer your Account to anyone else. You are liable for any damages caused by authorized or unauthorized use of your Account.

Privacy

The Widerberg Group takes the privacy of its Users very seriously. Please read the Privacy Policy (Part VI of this document), which is incorporated into these Terms by reference, for information relating to our collection, use, and disclosure of your personal information.

Authorized User

THE SERVICES ARE OFFERED ONLY TO USERS WHO PAY THE MEMBERSHIP FEE AND WHO ARE AT LEAST OF LEGAL AGE IN THE JURISDICTION IN WHICH THEY RESIDE. THE SERVICES ARE MARKETED SOLELY FOR USE BY SOPHISTICATED LICENSED REAL ESTATE BROKERS.

Real Estate Investment Opportunities

One of the Services offered is the facilitation of real estate investment opportunities during in-person or virtual meetings (each, a “Club Meeting”). The Widerberg Group does not endorse any opportunities offered by other Users, nor does it make any recommendations regarding the appropriateness of such opportunities for any investor.

Proprietary Rights

The Materials are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. User Content

You are solely responsible for User Content you post, transmit, or share through the Widerberg Group and for any actions taken as a result. You grant to The Widerberg Group a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, distribute, modify, and otherwise exploit your User Content for any purpose and in any media form.

User Interactions and Disagreements

Your interaction with other Users is solely between you and such other Users. If you have a dispute with one or more Users, you irrevocably release the Widerberg Group from claims, demands, and damages of every kind and nature arising out of or connected with such disputes.

Promotional Advertisements

Any and all advertisements promoted on behalf of IHAC or Ryan Widerberg (a licensed real estate broker with eXp Realty, LLC) are educational in nature and for educational purposes only. Promotional advertisements are merely educational with the intent of educating and increasing public awareness of alternative real estate programs.

Consumer agrees that their contact information — including name, email address, and phone number — may be shared with partner agents who conduct business in the same state the consumer proposes doing business. These partner agents do not explicitly have an agency relationship with consumer unless established by a written Buyer Representation Agreement or Listing Agreement. Phone numbers may be shared with partner agents for referral purposes as described in the SMS and Privacy sections of this document. IHAC may use consumer information as both personal leads and referral lead sources. Contact information is never sold to third parties for monetary compensation.

In order to be eligible for any reward, rebate, savings, or promotional offering, consumer must first claim said offering by checking applicable boxes in the consumer questionnaire they complete, or by indicating the program(s) via a signed Buyer Representation Agreement and/or Exclusive Listing Agreement. Promotional offers are nontransferable and may not be sold, bartered, auctioned, traded, or exchanged. Offers may be revoked at any time without notice. Offer void where prohibited by law.

Live Events

The Services may include tickets to live events hosted by The Widerberg Group or affiliated companies, in person or virtually. Attendance constitutes agreement to the following Waiver and Release: You irrevocably grant permission to The Widerberg Group and all affiliated companies to use your likeness in photographs, videos, or other digital media in any and all publications, including web-based publications, without payment or other consideration. You waive any right to inspect or approve the finished product and any right to royalties. All photos and videos become the property of The Widerberg Group and affiliated companies. Claims shall be arbitrated through the American Arbitration Association in Cook County, Illinois.

WE DO NOT ALLOW ANY VIDEO RECORDING OF OUR EVENTS FOR DISSEMINATION OR COMMERCIAL USE.

Entry into any live event requires a valid ticket, one per attendee. Attendees must be at least eighteen (18) years of age unless the specific event designates that children are permitted.

No Warranties

THE SERVICES, THE SITE, THE MATERIALS, USER CONTENT, AND ALL OTHER INFORMATION MADE AVAILABLE THROUGH THE SERVICES ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND “WHEN AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, THE WIDERBERG GROUP DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, CORRECTNESS, ACCURACY, AND RELIABILITY.

Prohibited Conduct

You agree to use the Services only for purposes that are legal, proper, and ethical. You agree that you may not, among other things:

Use the Services in any manner that could damage, disable, overburden, or impair the Services
Attempt to gain unauthorized access through hacking or password mining
Create user accounts by automated means or under false pretenses
Transmit viruses, worms, Trojan horses, or other destructive items
Defame, abuse, harass, stalk, or threaten others
Communicate thoughts or ideas inconsistent with Fair Housing laws or human decency, including thoughts or ideas against race, sex, sexual identity, gender identity, military service, familial status, age, religion, or any other protected category under Illinois or federal law
Upload obscene, defamatory, infringing, or unlawful content
Promote pyramid schemes, chain letters, or cryptocurrency brokerages
Impersonate another person or entity
Use any robot, spider, or automated retrieval tool without authorization
Share information about other Users or investment offerings obtained through the Services

Termination

The Widerberg Group may terminate these Terms and your right to use the Services at any time and for any reason without notice. Upon termination, IHAC may remove and discard any Materials or User Content. All provisions that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Indemnification

To the fullest extent permissible by law, you agree to defend, indemnify, and hold The Widerberg Group and its directors, officers, employees, affiliates, representatives, and agents harmless from any claim, demand, loss, damage, liability, or expense arising directly or indirectly from your use of the Services or the Site.

Limitation of Liability

UNDER NO CIRCUMSTANCES WILL THE WIDERBERG GROUP OR ITS DIRECTORS, OFFICERS, EMPLOYEES, REPRESENTATIVES, AFFILIATES, OR AGENTS BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Arbitration

Any dispute arising between you and The Widerberg Group that cannot be amicably resolved shall be finally settled in accordance with the Commercial Arbitration rules of the American Arbitration Association by one or more arbitrators mutually selected by the parties. Arbitration shall be held in the City of Chicago, State of Illinois. Judgment upon an arbitration may be entered in any court of competent jurisdiction and shall be binding, final, and non-appealable. The arbitrators’ fees shall be shared equally between the parties.

YOU HEREBY WAIVE YOUR RIGHT TO A TRIAL BY JURY WITH RESPECT TO ANY CLAIM, ACTION, OR PROCEEDING DIRECTLY OR INDIRECTLY ARISING OUT OF OR RELATING TO THESE TERMS OF SERVICE.

Choice of Law

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict of law provisions.

Notice

Except as explicitly stated otherwise, legal notices to The Widerberg Group should be emailed to ryan.widerberg@exprealty.com. Notice will be deemed given 24 hours after email is sent, unless the sending party is notified that the email address is invalid.

Force Majeure

Neither party will be responsible for failure to perform any obligation under these Terms due to causes beyond reasonable control, including strikes, lockouts, riots, epidemics, war, government regulation, fire, flood, natural disasters, Acts of God, or inadequacies of equipment.

Severability

If any provision of the Terms is found unenforceable, that provision will be modified to the extent necessary to make it enforceable while preserving its intent. The remaining provisions will remain in full force and effect.

Electronic Signatures

Pursuant to the Federal Electronic Signatures in Global and National Commerce Act (ESIGN) and the Uniform Electronic Transactions Act (UETA), your use of electronic signatures to sign documents legally binds you in the same manner as if you had manually signed such documents. By registering on the Site, you consent to transact business electronically and maintain electronic records.

Waiver and Integration

A provision of these Terms may be waived only by a written instrument executed by the party entitled to the benefit of such provision. These Terms of Service and other referenced materials are the entire agreement between you and The Widerberg Group with respect to the Services, superseding all prior communications and proposals.

Changes to the Terms

Your use of the Site and Services is governed by the then-current version of the Terms. The Widerberg Group may modify the Terms at any time without notice by posting updated Terms to the Site. These Terms were last updated on February 23, 2026.

PART V — SMS COMMUNICATIONS POLICY

A2P SMS Program Overview

The Widerberg Group, operated by Illinois Home Auctions Corporation (IHAC), uses an A2P (Application-to-Person) SMS messaging system through GoHighLevel CRM to communicate with buyers, sellers, and other real estate service inquirers who have provided their consent to receive text messages.

SMS Consent & Opt-In

By submitting the contact form on our website, you expressly consent to receive SMS/text messages from The Widerberg Group at the mobile phone number you provide. Consent is obtained through our web-based opt-in form, which requires you to affirmatively check a consent box or submit your information with clear notice that you will receive text communications.

Consent to receive SMS messages is not a condition of any purchase, service, or real estate transaction.

Types of SMS Messages You May Receive

By opting in, you may receive the following types of text messages from The Widerberg Group:

Property listings, market updates, and new listing notifications relevant to your search criteria
Appointment reminders and follow-up communications regarding showings, consultations, or closings
Promotional marketing materials, including information about our programs, rebates, and special offers
Transactional updates related to active real estate transactions, offers, inspections, or closing timelines

Message Frequency

Message frequency will vary depending on your inquiry and transaction status. You may receive multiple messages per week during active transactions. Promotional messages will be sent periodically.

Message & Data Rate Disclosure

Message and data rates may apply. Your mobile carrier’s standard message and data rates will apply to all SMS messages sent and received. The Widerberg Group is not responsible for any charges incurred from your mobile carrier.

Opt-Out Instructions

You may opt out of SMS communications at any time by replying STOP to any text message you receive from us. After texting STOP, you will receive a single confirmation message acknowledging your opt-out, and you will receive no further SMS messages from The Widerberg Group, except as required by law.

Mobile Information Sharing Statement

Your mobile phone number and contact information may be shared with licensed real estate partner agents who operate in the same state in which you are conducting business, solely for the purpose of providing real estate services, referrals, and follow-up. Phone numbers are shared only to the extent necessary to facilitate the real estate services you have requested or inquired about.

Mobile opt-in information, including your phone number, will NOT be sold, rented, or otherwise transferred to third parties for marketing purposes unrelated to real estate services. Your information will not be shared with non-affiliated data brokers or data aggregators.

Carrier Liability Disclaimer

Mobile carriers (including but not limited to AT&T, Verizon, T-Mobile, and others) are not liable for delayed or undelivered messages. The Widerberg Group is not responsible for delivery failures caused by your mobile carrier or network conditions.

Supported Carriers

Our SMS program is supported by all major U.S. carriers. However, carrier support is not guaranteed for all mobile devices or service plans.
